Legal advice on fighting for a foster child we have had for 3years. now the dad wants custody.

We have custody of a girl that will be 4 next month.her mother signed custody to us threw the Department of Human services to keep the state from taking custody, as she was a young single parent that had been reported several times for neglect. they were several different boys that had to submit to a paternity test. the father of the girl was put in a juvenile jail when she was 4 months old for theft. it was not his 1st offense. he was also in drugs and alcohol.he got out a year after we had kenzie.he has always been welcome to visit and did. he started off really good with her for about 6 months,then got back into drugs and drinking.he would come to our house and just sleep,not do anything with his daughter. now for about 1year and a half, he has quit seeing her never saw her on any chri

It sounds like the dad is irresponsible and couldn't provide for your daughter anyways. Next time you see the dad, you might try talking about how much time and money it takes to raise a child. He may hear you and start to realize that raising a child is more hard work than he can handle. If the dad tries to take you to court, I hope the judge would consider that you provide the child love and stability, while the dad cannot really provide anything but uncertainty.

I feel for you, really I do, we are going through basicially the same thing, granddaughter is going 3 yrs and Mom wants her, she was taken at birth and we have had her all this time. We don't want and are afraid for her to return home, she is such a tiny little thing. DHS says they can't terminate, and looks like she might go to her moms, I pray for others in the same boat, this isn't easy at all for all involved, especially the children. My heard goes out to you- from Oklahoma
