Legal Guardianship or Custody?

Need help not sure what to do my sisters children are 9 and 14 and my sister may or may not be on drugs really not sure. Children go to school dirty hair not combed etc. My sister does not cook(eat out every night) or clean both children are overweight(9yr old weighs 126lbs 14yr old weighs 210lbs). I live in one state they live in another. Unfortunately my sisters husband was killed in a car accident in 2007 she lost her job that year(before he died) and I know things are rough but she will not go to counseling or put the kids in counseling and I am afraid they are heading for not only trouble with their health but also emotionally. My husband and I would like to get custody of the kids are just to have guardianship for awhile till she gets herself together my sister says ok but then we hear nothing from her. Please help I am very concerned about the children. What should my first steps be?
