Even if you had sole custody, you would still need to notify your ex of the move and if he contested it, he could then take you back to court to fight it...contact your ex and go from there.

Even if you had sole custody, you would still need to notify your ex of the move and if he contested it, he could then take you back to court to fight it...contact your ex and go from there.
If he decides to fight it, you may be able to leave anyway. the only catch is that you'd have to go back to his state for court. if you do leave and dont come up with an agreement with him, he has 6 months to file for you to come back, or he would have to go to your new state for court.
So you don't have the main custody of the child?
if you don't, that might be kidnapping, so i wouldn't do it.
