My 9-year old son wants to live with me what are my chances in Indiana

I will be going to court for the second and final time for a modification of custody from my ex girlfriend (we were never married) this is a paternity case, to get custody of my 9 year old son. We have been to a counselor and he has given his report which is very favorable towards me and has reinforced my claims that my son wants to live with me. The mother is to say the least very unstable and she has been involved and found guilty of various drug related crimes and is currently on house arrest. My question is I know that some fathers have automatically been labeled "deadbeat Dads" however I'm not one of them I'm current on my support and have never missed a visitation. What are my chances of getting custody of my son away from his mother

I think you have very good chances based on the mother's drug activity. No-brainer if you ask me. Good luck.

It sounds like your chances are good if everything is true. The judges like both parents to be available so she may have visitation, but based on her unstable past and current situation she may get very limited visitation. The age when a child's opinion is factored in is typically a few years older (13 ish) but check with your state laws
