Since, neither of you have custody of the child you can take back the child back. You may have to get law enforcement to go with you but they cannot make the father give the child back to you. They can make anyone else give the child back.

I agree with thyme, no one has custody so you have every right to that child. even if you need a police escort to go get it.

I would file some sort of custody agreement with the courts to make sure something like this can't happen again.

good luck.

Get a job. Has the father taken a paternity test? I would sit outside until they gave her to me,then I would go to the courthouse to file for a patrnity test, then set up and appointment to speak to a mediator to arrange custody/visitation as to what is best for the child. Court fees are expensive but there is a waiver that you can take to a judge and have him approve it because you cant afford the costs. He cant just keep your baby from you,the mother needs to stay out of it. What state do you live in?

If it is not the father and he is not established as the father then they cannot keep that child from you. GO TO THE POLICE IMMEDIATLEY IT IS KIDNAPPING. If he is established and you are no longer together then go to the courthouse and file an emergency ex parte order granting you temp custody. It doesn't matter right now that you don't have a job, but you might want to think about getting one for yourself and your child.
