My boyfriend and I live together in CA and have a four year old son. Do we share custody of our son?

Both my boyfriend and I are 31 year old working professionals living together, paying bills together, and raising our son together. We were hoping to rent a home from my boyfriends mother, but she is demanding that we get a joint custody agreement regarding our son before she rents to us. I am in shock at her demand. Currently, all parenting decisions are made together equally and I do not appreciate being told how to be in a relationship or how to raise my son. Legally, though, not married and living together since the birth of our son...do we currently share custody? If not, how does custody work in our situation. I appreciate your guidandce and assistance in this matter.

I am a CA father who was living in a similar situation. Even though you acknowledge he is the father and even if he is on the birth certificate, becasue you were not married when your child was born, you do not share custody. If you truly want to establish joint custody, you will first need to have paternity established by the court and then you can establish joint physical and joint legal custody. I just went through it when my X threatened to leave the state with our daughter. I had to hire a lawyer and rush into court on an emergency basis. If you truly respect your boyfriend and care about your child, you should get the process done now, when things are good. Because it can end up being a huge point of contention in the future and, as in our case, was the reason our relationship finally fell apart. If you both agree, you can get the forms from the court house and do it yourself.
