My ex pays child support on his "salary" but not his "extra income" which is twice as much. What can I do?

My divorce went through a year ago. At that time, I didn't get a lawyer (stupidly) and my ex and I decided on 50/50 custody. He still pays a small amount of child support based on his "salary" but not on his "extra income" which is actually TWICE as much as his salary. I know this from our years together being married. Is there anything I can do so he is paying the fair amount for our child? Also, now that our child is going to be going to school next year I would like him to be placed with me during the week so it's more stable. Any advice? My problem is I was a stay at home mom so I had no money of my own during our divorce and now am just making it with no extra for a lawyer now. I submitted bank statements to the state of florida's child support enforcement address to show what he actually makes, but that was back in December 2007 and have never received anything from them. Not even a rejection letter.

I am not quite understanding what it is your asking. If your child does not stay with you though the week why are you recieving child support. If he makes more money than what he states then you need to file a motion to the court and ask for an increase of child support. Take any doucumentaion that you have showing what he makes. I would ask for joint custody and have your self as primary care giver of the child. Unless you get an order of support and visitation though the court nothing will be legal as of now its just verbal. Also sending statements to childsupport will not help you because they are not the ones that order the support. to change that order like I said you have to go back to court. You can call free legal services and see if you can get help from them they go by incom.

You can ask for a modification request . The request can be submitted every three years. Call the child support office and ask them to send you a form. It took almost 4 months total for my child support to be modified, so you will want to act fast. After you submit the form wait a couple of weeks then call the office atleast once a week. They will note it as well as check on it for you. Good luck!
