If there is no child custody stating he has visitation then she can move where ever she wants to. Although you have to no that until the court actually gives the mother custody she deos not legally have it established though the court. So he does have an option here if he was to file for custody before she were to leave then the court could prevnt her from leaving. If he chosses to do this then at that time the court would probarly give them joint custody and physical custody to the mom. There would be court ordered visitations for the father and child support would be ordered. If both parties don't agree on one or the other to take the child out of state then the court usally will not allow it although it can be stimpulated that either parent can take the child out of state for a vist to family members ect. But there would have to written agreement from each to the other before leaving.
