Child Custody

If one parent has temporary custody and the other parent ( lives out of state) wants custody back. Is there a restriction on the parent who has custody making it where the parent who has custody can't move out of the state once the custody issue is resolved without the permission of the other parent that lives out of state?

The parent that wants sole custody would have to go back and file for custody in the state where the tempory order is filed. If that is done and the parent that gets the custody would have to ask the judge that they could move out of state and if he says yes then it would have to be stipulated in the divorce degree. If this is not done then the court usally states that neither parent can move the kids out of state,but they do allow you to take the kids out of state for a visit as long as both parents give written notice when and how long they will be gone.
