How old do i have to be to live with my dad instead of my mom?

You have to be 18 to decide who you want to live with.

unless you can get your dad to go to the courts and change the custody agreement, you'll have to live with your mom instead.

It really depends on the state. From all the resources I have gone through you need to be at least 12 to 16 years of age. I believe you may have to go to the courts and have your dad file a motion so that the judge can hear what you have to say. Call the family courts in your state and ask them about filing a motion so that you can change to live with your father.

It depends on the age of the child the courts will listen to the childs feelings at 13 and up. The parents should talk about this and decide what they feel is in the best interest of the child. I have seen two parents agree on what they both feel is best for their child and it works out just fine. the courts are there to help when they can't agree. If the child is under the age of 13 it is probary best that the child stay with the parent that does have the physical custody. I am surprized that the mother is allowed to move out of state with the child without the cosent of the court. It is usally stipulated in the divorce order or custody order that neither parent can move out of state with the child or children.
