I want to relocate with my son

I want to move out of state, my son is 5 years old and has lived with me from day one, his father and I were never married but we did go to court for child support, he is to pay every week. My question do I have the right to move and can he make me say?

Usally the courts state that the child or children not to be taken out of state by either parent. Who has the custody? Usally it states all this in the custody order. If you have not filed for sole custody you should do that . Until the court awards you custody you haven't got custody. It has to be establed though the court. You can file and ask the court when you go to court to allow you to move out of state,you can also get joint custody leaving you having physical custody. Giving the father more visitations and he might agree to that. You both can talk and try to work this out and file together as an uncontested custody. The forms can can be found on line under legal forms. They also may have a video showing you how to fill out the forms.
