Moving out of state

My fiance has sole physical and joint legal custody of her 2 kids and I live in another state. We plan to marry and move. What can the ex do to stop this? He has every other weekend visitation but doesn't interact in their lives at all besides that. The state is Virginia and the kids are 4 and 6. I don't think he wants to spend the money to fight it in court but he may just for spite. What can I do to get them out of state and can he stop it.

Well usally in the custody order it stipulates that the children are not to be moved out of state by either parent and that either parent has to give notice to each other if they want to take the children out of state to visit anyone like family members ect. She can file a motion to the court to modifly the orignal order asking that she be allowed to leave state because she is getting married and that your job is out of state,that can make a big difference in getting her to remove the kids. The judge usally allows to make exceptions in the case of one or the other parent needing to move due to a job and in this case you would be the supporter of your future wife. She can try talking to him and see if he will consent before moving forward on this giving him the oppunitly to agree.
