My wife and I are seperated she wants to move from CA to OK, What can I do?!

Was just seperated a few days ago. I couldn't find a job in the city we were living in. I got an offer from a guy a month earlier that he would give me an apt and a great job in sacramento about 2 hours south of where we lived. So I finally decided that since we were gonna get kicked out of the house we were in to take the job. She didn't want to come with me. So she's still in the house that she will be kicked out of and has no electricity. Our son has been staying with my parents for two weeks now which is an hour south of where i'm living and 3 hours from where she is. Now she has no money no job and soon no house, so she's talking about moving to OK with her mom and taking our son with her. I don't know what to do I can't live out there with her mom it would not be good for me or our son. What are my rights? How can I get him to stay here?

You can stop your wife from taking your son out of state. You need to file for joint custdoy ASAP before she leaves,the court will stipulate thart neither parent can mpve out of state with the child. This is comom in all custody orders. Neither one of you have legal custody if you are apart. Custody has to be granted to the parents though the court. If she does move before you can get joint custody you can still have her served she would have to come back to court. She will not be able to file for custody in another state until she is a resident and that is usally in 6 months.
