Sole Custody and Moving

I have 2 children and have had sole custody for as long as I have had them, they are 5 and 8. They do have different fathers. My daughter's dad (8 yr old), has reasonable access upon reasonable notice and has had that for 7 years. 6 months ago was the first time he opted to take her for a visit. Him and his new gf dont want her there nor does she want to be there as she has stated, and has not been back since. He does not pay child support as there as never been an order, he has not been involved in her life other than 2 visits I got my daughter to agree on at 7 yrs of age. I want to move to the states to further my education by transferring my college and entering university to make a fresh start, i have money saved to purchase a home and make a nice life for my children, what are the chances I will be approved to move my daughter. Keep in mind I am dual citizen. My ex doesnt have an interest but his gf is stopping him from agreeing just out of spite. I would like to know what my chances are?

If you have sole custody, you should be able to do what you want too. even if she complains, you go to court, the judge ok's it when he finds out how little he is involved the kids life

This is a hard one because you are in another country. Your laws may be different. You need to call an attorney and see what your rhights are there in regards to taking your children out of the country. I would think that the absents parent of both of your children would have to agree,however you should be able to file a motion with the court there and get consent to move your children. I don't understand why your not getting child support and I would also file for child support. Maybe when he starts to have to pay his child support, he might have a little more right to have a say. It sounds like your doing a great job and to want to better educate yourself to provide more for your children is great and I don't see why any judge would not allow you the move to do just that. I hope that your laws are like ours and if so you should be find. Good luck

I do not recieve child support for my daughter because when we first went to court for custody 7 years ago he and I were both students (we were quite young) and he was living with his parents. Since then it has been hard enough having him be any sort of part of my daughter's life, that I didn't want to ask for money which would cause even more negative feelings and in return even less of an interest (if possible) in my daughter's life. To me, any time weather 5 or 10 mins visit which happened through bumping into one another is better then having his money. My children and I have done well despite being a single parent as well as young parent, I didn't need his money nor did my daughter but she did need any time she could get. I will be writing a letter to the judge and filing a notion, I was 16 when I had her and since then graduated highschool, months away from graduating college with a 90% GPA, have managed to save a considerably amount of money for a downpayment for a home and have accomplished so much more for myself and children with no outside help. I have always thoroughly thought things out and only have done what is best for my children. I truely believe that moving away to finish University and have a fresh start is not only benefical for our family's future but also for the individual futures of both my children. Hopefully a judge sees it as such.
