State lines in Texas.

What are the laws concerning filing for divorce and leaving the state with my child? Am I able to leave the state of Texas before filing for divorce? What procedures should I take in order to obey the laws of Texas so I do not create more problems than I am already facing?

The thing is if you have not filed for custody of your child then you do not legally have custody. You would need to file for divorce or for custody if your not sure if you are getting a divorce. At that time visitations will be stipulated for the father and child support will be ordered. The court usally stipulates that neither parent can move the child or children out of state and that if the child or children go for a visit out of state then the parents have to give written notice to each other prior to leaving.So if you leave without your husbands consent you are leaving the door open for him to file for custody of the children. you would be sreved and would need to appear on the court date or he could get the custody. you on the other hand cannot file out of state for custody until you become a resident in the state that you move to and that would be 6 months,and in between that time you could have a problem with your ex.
