Unwed mother to move from Texas to Mississippi, no custody orders in place

I want to move with my 2 yr old to MS, where I grew up and have extensive family and support. My boyfriend and I have lived together for the last 2 years, but we have no court orders concerning custody. He did sign the acknowledgment of paternity form at the hospital and has supported us. I do have sole physical custody of the child, but if I move, can I be forced back? I have no problem allowing ample visitation, I just want to be able to move home. He has a lot of money and will not hesitate to use it for attorneys. Do I have a chance? What shold I do?

You would have to file a motion with the court asking for sole custody. You are not married so there should be know promblem with moving out of state as long as you give him visitations. If you allow him to have joint custody he will have more say in the decitions that you make about your child. He will also have more visitations. I would file before he does.

In response to

could it be that simple? Doesn't he have to be informed when I file the motion? If he objects(and he will), won't I have to then stay and fight him?
