Wanting to Move on with Sole Custody

I was reading some of your answers for questions on custody matters. I have sole custody of two girls. Ages 5 and 10. I have been divorced for about 3 years now and want to move closer to Family. From the state of Georgia to Tenn. The girls Dad is well a loser, cant hold a job, fails drug tests, lives in his mothers home, drives his mothers car,, and he threatens me that I cant take them. I have contacted my lawyer to make sure but I have not heard back yet. I'm tired of being cussed out each time he is around and just need a fresh start for me and my girls. Does sole custody allow me to move with out going through the courts,, and what about visitation? He currently gets the girls every other weekend, he refuses to work out a schedule with me so Im kinda lost...

Well if you are divorced now it would all depend on what was stipulated in the divorce degree on being able to move the kids out of state. In most cases in a divorce the order usally stipulates that neither parent can move the kids out of state. It usally states that either parent can take the children out of a state for a visit as long as you give notice to each other. So you might want to check your divorce degree and see what it says. You can pertition the court and ask them if you can move.

Nothing is in my divorce degree about moving, only that he gets to visit them every other weekend.
