What are the chances of the mother of my children being able to take our children out of the country to reside?

I am the father of two toodlers who where born and currently reside in PA. I was never married to their mom who by the way is from the UK and is not a US citizen. We are currently in the midst of a custody battle where she is seeking primary custody and wishes to move back to the UK with the children. I of course do not wish for the children to be permitted to leave the US to reside with their mom in the UK and therefore am seeking primary custody as well. What are my chances of being awarded the honor of being my childrens primary caregiver and what are the chances she will be given permission to take the children out of the country to relocate to the UK?

WOW there are several issues here. First her not being a citizen. The courts want what is in the best interest of the children and that is their primary concern. It looks like you might end up with joint custody,meaning you both would have to make the choices involing the children together. I believe that your chance of getting custody is about 50/50. Once their is an order if she is allowed to take the kids back to the UK cause she is a citizen there,then once she goes back then I would think it would no longer be in the hands of the US. If he gives you joint custody then she would probarly be allowed to go and you would get summer visitation. This is going to be hard for the court to rule on. If she was a us citizen I have no dalt that you would get joint custody with mom having physical custody. Is theres away that you two can work together and make a decition without the court having to where you both will have shared time.
