Pleas help my sons father is addicted to drugs and abusive to me

I have been in a battle with my x-boyfriend since we have been together. 7 months ago i had a child with him, everything seemed to be fine. He kicked me out of our apartment and he didnt care where i went with our son. It seemed he may have had an awakening and wanted to see his son i allowed visits as long as i was recieving child support,. He finally got a job in november of 07 which he still currently has. Now all of the sudden he doesnt want to pay anymore and i have filed for child support. He called me last night and told me he was going to file for child custody. He has been physically and mentally abusive to me in the past he definately has anger issues. I only have friends testomony to say he has done this no police records. He is also a avide drug user and he lives with his mom and her boyfriemd who are also avide drug users. I dont want my son to stay with him for weekend custody i am afraid he wont bring him back. I am ok with a supervised visitation as often as he likes. My main question is how do i go about a custody hearing with what i have and win with only supervised visitation.He also threatened me last night when he called saying he was going to have his mom and family beat me up. He always wishes that i had an abortion and that he never had the baby with me.He has a very short temper he cannot handle a 7 month old or a child. He doesnt have his drivers license and has been in multiple car accidents, so i dont want him driving my son around either HELP ME

Get a lawyer, legal aid or what ever, demand that he has to take on the spot drug tests, once the tests come back positive your laughing!! just make sure your clean or all deals are off! If his mom also abuses than make sure you state that, no court will let a child hang out with drug abusers. If you want a quick full custody , stop receiving $$ or anything else from him, cancel your request for child support, say you will take care of your child , and you dont even eccept a penny from him. He wont pay if no ones asking for $$. Then you my friend are clear to do with what ever you and your child wants!! Be the Boss You Call The Shots!! Remember dont tell him anything you have in store for him, he might use it to bit you in the ass! Good Luck!!

You must record all phone call that you have with him so when you go to court you have everthing you need to prove what kind of to person he is.The next time he threatened you, you need to fild a restring order on him for you and your child that way he cant get to you and your child. You can not let him off even if you tell you want what you want to here because he will try to get you to drop the restring order not do it fight like hell to proteace you child.good luck

You can file for custody yourself,you can go to the court house and get the papers and then have them filed. You can also contact free legal services and see if you can qualfly for help. They deem your incom. You can also file for child support and get it where it is paid for though the court. You did not marry this man so he is not going to be able to get custody. Also let the court know about his accidents drinking promblems and drug use and ask for supervised visits until you feel he is responiable enought to see his son on his own. If you appy for any help for your child though the social services then you won't have to pay for anything,they will prusue child support for you. The burned of proof is upon the father to prove he is or is not the father,and while he does that he will still have to pay child support. I wish you luck and your doing the right thing by not letting him see the child until you go though the courts. Also do not let him threaten you and if does it again call the police and make a report and get a restraining order if needed. This will all help your case when you go to court.
