Preventing Guardianship by absent parent

I am single mom of 7 yr. old, with sole custody. Father has never seen child other than in court to establish paternity at 1 yr. old. No contact between him and I either. Father pay child support only when in country (dual citizenship) and only as needed to stay out of jail!

What are the laws governing guardianship in the event of my incapacitation or death? Am I able to dictate who will have guardianship, and specifically guarantee that his biological father will never be considered for the role?

I fear my son's safety and well being would be in grave jeopardy if ever his father was granted custody/guardianship.

If you haven't made a will, you should do so. You can state your wishes as to guardianship of your children in the will. There are online will services available and it's not that expensive.
