Problem with law guardian

I am a single mom, and my daughter's father and I have joint custody, but he has physical custody at this point. I was living in an apartment on a street that became unsafe for me to raise my daughter. When my daughter went to live with her dad, he changed her school. The judge told me to find a new place to live and then go back to get my daughter. Since then, I have done that. Now I went to court to get my daughter back. My daughter spoke with the Law Guardian. My daughter has been telling me that she is unhappy being with her dad and that she wants to be with me and that her dad does not spend time with her. She also did not do well in her report card. The Law Guardian basically lied in court stating that her client is very happy with her dad and that she loves her school and that she is doing well. The law Guardian is against me and it is more than obvious to me. She in my opinion is not looking at what my daughter wants. My question is: At what age can a child in the state of NY talk to the judge and express what he/she wants?

I beleave it is age 13, and if your daughter is that unhappy file with the attornys office and have the law guardian switched, even go as far a writting the judge personally explaining your concern and ask for the case to be reavalluaded.
