Relinquishing rights without consent for adoption

Can my husband adopt my son without the consent of his biological father if his father isn't paying his child support and has been absent for 6 months

I am not shure i heard that if you do not know were the father is located they will run an add in the paper in the last place you are aware of he lived in an if there is no respones in 60 days they will go threw with out his consent but if later he becomes aware of it he can show just cause he didn't see add or was outta town an can prove it , he can later fight it but has to show great proof...i am having simaliar situation

Again, these laws very from state to state, in Colorado for instance the biological father must be absent (no contact) and have failed to pay support for 2 years before the court can be petitioned to terminate parental rights leaving the child open for adoption by the step parent. You should contact a lawyer regarding your rights in your state, most will do a free consultation.
