Should he get another attorney

My good friend fileed for divorce over 7 months ago. He has been to court on 3 seperate occasions. The last court being in October. At that time he was advised by his attorney that it could be anywhere from 30 to 90 days. Well the 90 days rolled around and finally the report from the commisioner was filed and stated that the parties would have joint custody with him having primary physical custody. However, the report also showed that he was responsible to continue paying for the ex's vehicle which is over $600 a month, half the mortgage (which she lives there with another man and has so since he filed for divorce) and he would also be responsible for paying her $300/month child support. Why would he be responsible for all these debts and her be debt free, especially with them granting him primary custody? Does this sound right or like crooked politics? His ratio for income to debt is $900 in the hole with him being responsible for all that is recommended. The report also stated that the ex-wife was to come out of the divorce debt free. Is my friend getting the shaft?

Your friend is most certainly getting the shaft! I would contact another lawyer!

Maintenance depends on a lot of factors. How long were they married? What kind of lifestyle did she have prior to the divorce? Did she have a job prior to the divorce? It's a tough situation, a lot of men get the shaft because the wife had no means to earn income. So, she gets scared and asks another guy to move in, setting herself up for another breakup down the road.

Custody is different altogether from Maintenance. The $300 he pays her in Child Support is for the kid, and unrelated. The whole thing sucks but a lot of guys go through it.
