Sole custody

What i am asking is.when i married my wife she had a 2 year old son.his dad had never even seen him.five years later his dad starts paying child support and sees his child for the first time.he was aware of the child for the previous 7 years and did not care.last week he took my wife to court and got full custody even though the child does not want to live with him.next week we have to be in court where he is trying to legitimize the child.my question is how can he receive full custody if the child is not legitimized.we are the only family the child has ever known.

The judge will try to make the best judgment for the child and that seems odd that they would choose him. What things came up in court? Have either of you had drug charges, abuse charges or anything that could constitute your home as less fit than his home?
