You need to file for a divorce and ask for sole custody of your child and asap. This girl friend of his should of been arrested for assault abd breaking and entry. If you have a restraining order all you have to do is call the police if she so much as calls you. As long as you live with your husband it is hard to stop him from doing anything like taking the child leaving or taking the child over to this girls house. It sounds like your husband is a loser if he can't even defend his wife and child. Your only chance for help is by leaving and filing for divorce and if he has to be deported back to mexico it is his own fault. Be carefull this sounds really serious and you have to look out for you and that baby.

Can I get sole custody if I have have restraning order with his girlfriend?
My husband has been having an affair with his ex girlfriend since before we got married. I have a 5 month old son and my husband and have not been living togather since I was 6 months pregnant. He only sees his son once a week for 3 to 5 hours and that is all of the of the time he spinds with him.
I had to file a restraining order against his girlfriend. She has vandolized my car, broke into my apt stole all of my pre prgnancy clothes and pictures of me, she came to our bedroom window at 5:30 am and demanded to speek to my husband, she tore the screen off the window and proceed to beet me while I was 4 months pregnant. My husband just sat there and did nothing through all this.
My husband is from mexico and my fear he will take him to mexico and or have him around his girlfriend and she will be abusive to him since she is my child and looks just like me.
I belive he married me for a green card we have been married for less than a year and has one more year for his green card to be laget.
Do I have any rights to get 100% sole legal and physical custody?
