If you have joint custody now and you want to modifly the orignal custody order asking for sole custody you need to file a motion though the court. If you have never filed a motion for custody then you need to do so. If there is a visitation order in effect now that can also be modified when you ask for sole custody. You will need to show the court any evidence that can prove that your ex is having a drug promblem and drinkinyect,the court will then do one of several things,the court can take away his visits,order supervised visits and order your ex into a treatment center for drugs and the court can order that and if he does not follow though with the court order hee can be geld in contempt of court. As a mother you have to be responiable to see that your child is safe as the court will also do,so it is best to file for custody,and I would not be taking my child to see his father as long as he is having these serious promblems,you nor your son need that. You can go online to freelegalforms.com and download custody forms and a wavier form if needed so that you will not have to pay for the filing fee and court cost. Also a finiacial form showing the court that you do not make enough to pay for these cost.

Can I get Sole custody of my son?
Ok I wanted my son to know his dad even though we were getting a divorce. For a year he never paid child support(not a big deal) he always used the excuse that he could not come and pick him up so I took my son back and forth to make sure he could see him. Then I found out he was using drugs and drinking and driving when he had my son with him. He not too long ago he broke into peoples cars and stores to steal their money and credit cards. Then he used the cards in other stores to get money to buy his drugs and got caught on camera with his other new born son with him. He got put in jail for 6months. He got out a few weeks ago and has not came and seen him once and is already doing drugs again. What can I do?
