Can I go and pick up my daughter?

I signed a piece of paper, but did not have it notarized but stating that I give my cousin temporary custody of my daughter. It has been 5 years since then, I have been trying to establish stability in my home so that I can bring my baby home, is their someone specific I have to talk to or do? My daughter has expressed how much she wants to come live with me. My daughter is seven now and is staying in texas. she has a guardian ad litem. I feel as if I am running out of time and don't know the things that I should.

Well first of all you signing a statement letting your cousin tempory custody is not legal. If you have legal custody of your child though the court you just need to take that and the policw and get your child. Anytime that a parent wants to give guardianship or custody to someone in the family it has to go though the court. That is why we have courts. If you have never filed for custody of your child though the courts then do so now because you have every legal right to have your child with you even had you went though the court to give your cousin custody does not mean you can't file a motion to reverse the orignal court order. Your cousin if she has not filed for custody of your child though the courts then she does not have it. You would know if she had because you would of had to be served. I hope you will be able to just go get your child, let me know what happens and I wish you the best.
