Can my kids be taken away if my live-in boyfriend gets a drug charge

I have sole custody of my kids.my boyfriend lives with me and recently got multiple drug charges. if convicted, can my kids be taken away even if they are never in any harm?i do not use drugs,have a clean record, and drugs are never used around my kids,but i've heard that they can be taken from me...

Yes, they can, if your state child welfare agency believes that your boyfriend has created an unsafe environment for your children.

However, what usually happens is that the state child welfare agency will order the boyfriend to move out of your house. If your boyfriend does this, you will probably be okay. However, if they find out that your boyfriend still lives with you in defiance of the order, then your children can be taken away. When this kind of thing happens you have to ask yourself which is more important to you, your boyfriend or your children. If the answer is your children, then you should make sure that your boyfriend moves out and does not come back for overnight stays.

All of this depends, however, on a finding by the child welfare agency that your household is unsafe for the children due to your boyfriend living there. This is somewhat likely to happen, but until it does your children will not be taken away.

You need to decide what is more imporant to you the children or the boyfriend. There is no excuse for your allowing drugs in your home period, and if the CPS were to come to your door and find that there is drugs in the home they can take the children on the spot, you can be arrested as well as the boyfriend and anyone else in the home over the age of 18. If your boyfriend gets busted for drugs from someone else's home and is arrested, and then goes to prison, as long as he was not arrested in your home then they won't come in and take the children, your ex can use your boyfriend doing drugs as a reason to file a motion with the court to ask for custody, he only needs to show the courts, your boyfriends records of anytime he has spent in jail, prison if he has, and state his concern for the children while being in your care. If nothing has been done yet, then you have the chance now to get rid of the boyfriend, and move on, if you do not then you have to face any charges that could come of his living in your home with you and the children.

Since the answer by "tomturkey" i feel i should do some clarification. i stated in my question that drugs are NOT used around my kids, nor in my home. the charges that the boyfriend got were on his own time. he was taken to jail from my house, but because he had a unknown warrent, and in our town everyone knows everyone, including police. there is no question to who is more important to me..kids..duh, people! also, in respone to "tomturkey" i have sole custody of the kids, the biological father is nowhere around, i was mainly asking i guess, if the state could take them from me if he is convicted of these charges. he also has his own house/mailing address, since it is not my address does that make a difference? thx for the answers.

Hi Like 2know, I want you to no that I did not in anyway mean to insult you as a mother, I guess that I misread what you stated incorrectly, I read that your boyfriend lives with you and that he recently got multiple drug charges. Usally when a parent states they live with a boyfriend and he gets charges bought against him for drugs, that the rule of thumb as they say is that the parent would have knowledge that that person does drugs. The only time you would have to woory about your child(ren) being taken away from you is if the police found drugs in your home, and if that were the case then they would of already taken the kids. If your asking what the likely hood of losing your child(ren) because the boyfriend has charges against him, no there is no reason the court would have to take the children when were not involved and there were no charges bought against you. You can rest assured if he is convicted your kids are not going to be taken away, the system does not work like that, they cannot take away your children for a crime you did not commit. I sorry for the misunder standing.
