Change of custody

I have physical custody of my children. The divorce decree states joint managing conservetorship. My ex lives out of state.
My children are with me in a loving, stable home. Both my ex and I are remarried to other people. When we were going through the divorce he didn't contest that I would have primary custody. Now that he is remarried, he wants the children to come live with him. He is active duty military and has a deployable job. What are the chances, if taken to court, that he could be awarded primary custody? The only thing that I could think that I have against me is that I have been treated for depression. I had been treated for depression prior to the divorce decree, so it is not a new development.

You have done nothing wrong and being depressed is not reason enought to take the children away from their mother.One thing he has aganist him is the fact that he does have a deployable job so why would the court take the children out of your home. I do not believe you have anything to worry about. You can consult with an attorney for more legal advice but I believe you are going to be fine.
