Changing guardianship ,biological father has not been around since child was 2years old

Biological father has never been a part of his daughters life , Do I really need his authorization to give my sister full custody of my daughter? What is the difference between temporary guardianship and legal guardianship? I can only find applications online for temporary Guardianship.

The difference between custody and guardianship is with custody it is permanet and the guardianship is tempory,meaning the absent parents or parent can file for custody back at any time they want. In order to give custody or guardianship the absent parent has to be notifien that is one of the process's to getting custody or guardianship. The absent parent has the right to ask for custody if he knows the mother is giving the child up.

Just to clarify...the father wants nothing to do with his daughter, he has never attempted contact after separation/divorce. My daughter is 16 years old, since it has been over 14 years since the father has even seen/spoke to his daughter do you think their is a chance the courts / a judge will take this into consideration and somehow override his authority?

Can you specify how long it takes to complete the process? Once documents are submitted to the courts.

I would guess that meaning the father has not had contact with his daughter that he probary wouldn't try going to court to get custody. There are alot of factors involved here if he has not paid child support he will be afraid to appeal in front of the judge,also your daughter is 16 years old and old enought to have a say in this. I think it will be fine letting your mom having the guardianship. This can actually take a few months depending on if the father is served. If you do not know where the father is just tell the couts and they will just run an ad in the parper twice a week for three weeks and then you'll get a court date. I also believe there is a law if he has not been in the childs life at all within a year you can have the right to do what you want. This will be fine don't worry he is not going to get your daughter I just wanted you to know how the process works.

Thank You so much. I highly doubt the father will fight for custody. I hope by some miracle there is a law which allows me to do what I want. I would think this would speed up the process significantly.
I plan on giving my sister custody.
