Child Custody

I am currently 38 weeks pregnant with my second child, I live with the father of this child and not married to him. We have been together two years. My son from my first marriage lives with us. My ex is seeking full custody of our son that we had together when we were married. We both live in the state of Georgia. My ex has recently remarried. My ex sees our son when ever he wants and has just recently paid all of his back child support up. He was way behind. I am a good mother, but not being married to the man that I live with I feel is going to hurt me, I can't make him marry me. We are engaged to be married, but have set no date yet. So how do I win in court to my ex with him being married and myself not married? My ex has lost so many jobs and has been on drugs, and hit me all the time during our marriage of four years. I am 30 years old, at this time. What can I do? I know the answer is to get married, but I can't ask him, he is suppose to ask me!

Well this is 2008 and times have changed I wouldn't worry about losing my child because your living with a man. Your right you shouldn't have to push him into marriage until you both are ready. You will have to go to court when they have the hearing because if you don't then the court could allow the fasther custody. If you have custody now and having a child the court is not just going to take your child away because your ex wants him. I would consult an attorney if you feel you need legal advice.

Let me tell you sweetie I am the same age and had a similiar situation. Well guess what he got married and I did not I was engaged and decided not to base the marriage on a court care. Well I lost custody of my two children and I was in Illinois and he was allowed to move my children to Florida. My Ex has the same tendencies as yours did and mine was even a diagnosed schizophernic. You better do what you need to do to get you kids cause when they are gone you will be sorry you did not get married I was. I am still engaged to the same person and trying to get my kids back. Make the man "marry you" or walk. Sorry to sound harsh but I have been there.

Being married does not make you a good mather or father, It just makes you married. If you take care of your child and are not taking drugs, You have nothen to worry about. The court does not like taking a child from it's mother even when the mother is not perfect. I beleive because of child support, men try to get the kids , not because they want them , just because that is the only way to get out of paying. Don't worry, Don't get married for that reason, that could come between you latter. You can be a family without being married. Good Luck
