How hard is it to obtain legal guardianship of a teenager? The mother is willing to proceed with any/all legal documents. I am the childs Aunt? What an POA work?

Power of attorney would not work because power of attorney only allows someone to make a decition for the person that has gave you the power of attorney in any effect that they can't make decitions like being in a coma ect. The mother can give you consent to allow for you to file for legal guardianship for her child. However it is required by the court that the absent father be notified of the mothers intent.

Can the mother file the required documents without the presence of either one of us( potential legal guardians)? Would me and my spouse both be required to sign the douments? The issue is we live in a different country (India) and my husband is planning to go to the US to retrieve my niece and bring her here. Please advise.
