Child custody battle when one of the parents owes back child support.

I am asking this for a friend of mine, her and her husband have custody of two boys, one of which isn't there biological son; however, the biological mother agreed that they could adopt him, and she has visitation priviledges and is supposed to pay child support; however, she is like $8000 behind and has recently filed a claim to not only regain custody of these two children, but to take the one child completely away. Can she do this?

If they adopted the kids, she should not be paying any child support.
If she only gave away guardianship, she may be able to regain custody, but your friends will be able to take her to court for money owed to them.

Thats right if your friends adopted this child, the mother shoulded be paying child support. I cant see her regaining custody. She would have to prove she has changed. I cant se her being allowed to just take one completely away. tell your friends keep track of everything she says or does for when it goes to court.

I am a parent who lost custody of my child years ago and is paying child support ,but I 'm still in the rear. If my child wanted to come back to live with me now since I'm married and I have myself together and he's about 14 years old how would I go about doing this.

She has ground to do whatever she wants to if they are her kids. the courts will have to grant her custody back, even if she owes back child support

Does he have sole custody and not tempory custody? If it is tempory there is always possible the mother could get the children back. Depending on what the court order states. She has to pay the back child support even if she were to obtain custody. As long as it was court ordered. If one of the children are not your biological child she may be able to get him back but the court does not like to seperate the children.Since the court has gave you custody you should be able to get visitations for both children. There are alot of factors here to address so if i were you I would contact an attorney for legal advice,you will need one if she is serious in filing for custody.
