Custody

I presently left an abusive relationship and have my two children with me. The father is demanding increased amount of visitation. i would like to apply for sole custody stating my visitation wishes. how long does this take to be granted this and if he was to contest it and not sign what happens then.

You just need to file a motion with the court asking for sole custody. You can ask the judge to stipulate that the father n have supervised visits due to his being abusive. The court may order him to seek help. He cannot contest what the court orders,he is served to appear in court if he does not you will get what you ask for,he on the other hand can appear and state his case and the judge will determine who is telling the truth and then order his decition. If you have a restaining order or ever had one you might want to tell the judge that.
