Father of my children

Three years ago, my ex-husband was sentenced to 6 years in prison for sexually molesting my oldest daughter, she is not his biological daughter. He became a US citizen in 1997. Will his citizenship be taken away when he is released? Do I need to apply for full custody of my boys or do I automatically have it because of his crime?

No he will and is still an american, once He became a US citizen, he will always be if he wants to be a US citizen, crimes dont take US citizenship away , and you need to apply for your boys , because they wont take custody away from him , but may not let him live with them for awhile, that may be in the court order, after he gets out , he will have to go though a lot of offender programs , and if he does all they ask , and they do a readjusment , then he will get to see , and maybe keep the boys like any other father, if he passes the tests, but there will be a lot of time , before he does this, and if you want to take full time of your sons , then get statred on this, he will have to agree to this, even with him in prison, but if you can show a judge what would be best for the boys he might agree to it

I would still go through and file for custody, just to have it in legal writing, but it should be cake to get

if he is a legal US citizen, i doubt he'll be kicked out of the country

Yes it is best to file for sole custody ASAP. Do not take any chances,it is always better when it is filed with the courts. You should also ask that court to not allow him any visitations and make sure you let them know what he did. I donot know if they will take his citizenship away from him due to the fact that after he gets out he would of served his time. But you ask an sttorney about that one. However as a sex offender that would mean he could lose his rights all together for seeing his children.

You will neeed to file a motion with the court to modifly the orignal order of custodyand support. Support stops at the sge of 18 even if the child is still in school. The mother will be served and she can appear in court and tell the judge she agrees to this or you can get a notized letter from her stating she has placed the child in your care and want to gine you custody.
