How can I get full cusody over my child?

I have a situation with my three year old son. I gave him his fathers last name because his lawyer said that I was not able to get child support from his father unless he had his last name. Well now its 3 years later and he never paid child support. I always recieved it by the government later on the next year and the money isnt really worth the wait. Well my question is how am i able to get full custody over my child? I don't want the father to have anythig to do with my son. He never does anything for him anyways (he doesn't call, write, send a card, nothing) so I want to completely x-out his father. Im worried that if something happens to me one day, instead of going to the father in his life now, they will give him to his biological father. Any advice?

If you talk to the father see if he will sign off on his rights and file for full custody. File for full custody even if you have no contact with the father.
