Is there a reason that you have waited so long? You can either consult an attorney for legal advice,or you can file a motion with the court asking for custody or legal guadianship what ever is easier for you to get in your state. You can down load the forms from the internet and print out fill them out and file them with the court. In this case I don't see a promblem with the court allowing you custody. The only promblem I can see is if the father is in the picture and wants the children,his rights would be considered. If he is in the picture and would allow you to get legal guardianship all he has to do is sign giving you consent to file for the guardinship.

How do i get custody papers on my two grand kids that i picked up from jail when they where born?
My grandchildren were born in jail. thier mother was incorserated at he time. I had to
take them before they were awarded to the state and put in foster homes. I want to get legal custody of them so that I am able to take care of them properly. What can I do and how soon can it be done? Thier ages are 3 and 6 years old.
