How do we get custody of my husbands daughter, we saw her twice the first two years of her life, not by choice, her mother isn't a very good role model, or responsible.

How do we get custody of my husbands two year old daughter, we saw her maybe three times the first two years of her life, not by choice, but her mom would stop contacting us, move, or change her number. She can't keep a job, bouces different men in and out of my step-daughters life. In March of this year she contacted us
saying that if my husband didn't want to be a part of his daughters life that he would have to sign over his parental rights, or else she was going to take him to court for more money. We have since been taking her a couple of days a week, with out a court involved, now it is July and she is saying we can no longer see her, because we only take her when we have time. We both work full time jobs, and my husband works any and all hours being he's an assistant manager. She can't keep a job, moves, and changes her number quite often. While we have been taking her the last few months, she sent me a message freaking out that her mother kicked her out and she and no place to stay, and we had to take her daughter, or they would have to sleep in her car! When she had a place to live and housing assistance in the first place, how does that happen, she had no job again.Then told us, she had no money for a place to live, and that we had to take her for a week, so she could go to Texas to get money from her fiance or move there. Our two year old son wants to see his sister, and we also have a 2 month old. Do we stand a chance on getting full custody?

Well I have to be honest with you it is hard to take custody away from the mother. It has been done but it is hard to prove that a mother is unfit. Even when you can the courts usally just order councling for the parent. If the child is old enought like 13 or older the judge will consider listening to the want of the child. Your husband would need to file a motion with the court to modifly the orignal custody order. If she is licking her child out into the streets that would be a good thing for her to tell the judge. My concern now would be doing this before she takes the child out of state. I would sure try to get the custody or joint custody and asking the court that she not ba able to take the child out of state to move.
