How is child abandonment determined?

Custodial parent left her children with grandparent for at least 3 days.Then the grandparent called the father and told him to come and get the children.He did that.The children said they hadnt been to school all week nor heard from their mother.The father has no phone number to contact the mother nor has she contacted him. As of right now he has enrolled them in school and and is in the process of trying to get custody.

The custodial parent cannot be charged for abandoment by law if the parent left the child in the care of their grandparent then that is not considered abandoment. Because the child was placed in a realatives care. If she had left the child in day care or with a baby sitter then that would be abandonment. The grandparents however does have the legal right to contact the absent parent. The absent parent can file for custody and if the custoial parent has custody already ordered though the court then the court will have to change that order until they do the mother will still have the right to come back and ask for the children. The father needs to contact an attorney for legal advise.
