By going before a Juvenile court judge and appling for temp coustody , someone has to have costody of the child / children they can,t be left with out a guardian , if not one of the parents the court will appoint a Guardian , a grandparent could get guardianship , or even a court apointed attorney could be given guardianship

You can get temporary custody. It is usally only granted to the parent that has the children while their being seperated due to a parent needing to file for things like social security benifits and other imporant factors that cannot wait for the length of the divorce to take place. My son just got tempory custody because he is diabled and needed to have proof that he had tempoy custody for enrolling the kids in school and getting medicaid ect. He could not afford to wait three months until the hearing.

You'd have to go to the courts and get them to put a order out for temporary custody.
