Well it all depends on what the mother wants. But then if your niece has custody now and it was ordered though the court then why would you think that you could get your grandaughter. If she is being cared for and happy and your niece wants her to stay with her then I don't see any reason as to why the court would just take her out of the home even to you the grandmother. I don't know why your niece has custody so it is hard to tell you what would happen if something happened to your son. If you have a good relationship with your niece there should be know reason why you can't see your grandchild. I am sure she needs you in her life so I would try talking to the niece.

If my son were to die, would my grandaughter go with her mother of stay with my niece, who has temporary custody of her?
Would I be able to gain custody of my grandaughter over my niece? My son has been diagnosed with bipolar disorder and sometimes during his manic episodes turns suicidal. If something were to happen to him, what would happen to my grandaughter?
