My Son's rights as a new Father

My son is a new father ,his son is now 3 days away from being one month. he's not married to the young lady ,and not currently employed . The babies mom will not let him see his son because he does not have a job. He is looking for employment ,but have not found anything as of yet. Do she have the right to not allow him to see him because he's unemployed ..Should he seek custody ?

What state are you in? Fathers have rights in some states the rights are the same as a married couple(some states Not All), it will depend on if your son is on the childs birth certificate. If he is then he can file for visitation. As a grandfather you cannot file for custody. Grandparents have some rights in some states but in this case you do not. The baby is only one month old. Grandparents rights and the fathers rights are two different issues' if the father is not on the childs birth certificate a paternity test will have to be taken prior to the father being able to file for visitation. The mother cannot keep the child away from the father because he is not working, but until a custody and or visitation is put in place though the court then she has the tight to deny the father visits.

Your son has a right to see his child, but he will have to go to family court and get a visitation order. If he wants to see his child he should go to court sooner rather than later. Of course, when he goes to court he will also likely get a child support order to go along with his visitation order.

But once your son has a visitation order, the child's mother cannot legally prevent him from seeing the child.
