Non married parents

I am not married to my childs father.
His name is on the birth certificate as the father.
If we break up, do I have custody of my son automatically until he takes me to court?
We live in Indiana

You need to file for custody so that it will be court ordered though the court he will get visitations and a child support order will also go in effect. Neither one of you have legal custody until the court appoints it to one of you,however you can both agree and ask for joing custody.
