What are my rights?

I'm the biological father of 2 children (ages 13 & 14). When the 13 yr old was 2 months old the mother left me & moved in with her parents with the kids. She told me she had a no contact order. I found out in Sept 2004 that the no contact order never existed. I went to court, got court ordered visitation in Nov 2004. At the end of 2006 she cut off my contact with the children. In April 2008 the mother died. Her family is refusing me access & custody of my 2 children. I have hired a lawyer & will be in court in a couple of weeks. What are my chances of getting custody?

I should add, i didnt find out about the mothers death untill about 3 months after her death. I have paid child support through payroll deduction as ordered by the court after the seperation. the Grandmother of the children filed for recieved a temporary guardianship without my knowledge and they KNEW where i lived and had my phone #.

You have every right to custody of your children. The grandparents do not have the right to decide what they want,the court has not gave them custody therefore they are keeping the children against your will. Well I see they have guardianship,guardianship is just tempory until the absent parent files for custody. Your chances of custody is good,and I would inform the court that the grandparents have never tried to get in touch with you about their mothers death. Good luck!
