What procedures do i have to go through to get legal custody of my son?

His father hasn't been around since my son was four months old and i left him because he was on drugs and was abusing the baby and now he is getting out of jail after being proven not guilty of murder and now he is saying that he wants to get his visitation and that he will try anything to get the child.my son is four years old and my husband has been there since he was 8 months old and he is terrified to meet his biological father.how can i make it to where the guy can only visit him in a place where we are both comfortable and the child isn't traumatized.

You need to file for sole custody of your son. You also need to file for child support. When you file for custody the court will give the father visitations. Well if he was found inocent of charges bought against him then you can't use that as a reason for him not to see his son or to ask for supervised visits. You might tell the judge you think he is still doing drugs and ask for supervised visits for that reason. The only thing that sounds strange to me is that your saying that your 4 year old son is terrified to meet his father, why would he be. Have you told him things about his father that would give him rason to be afraid to meet him, because he is to young just to know these things and to have these feelings of fear on his own.
