Will my daughter get custody?

My daughter is a good mother and has a car and a job,she wants to leave her boyfriend who is a weekend drunkard and has a bad temper and is verbally abusive.He also is on probation on a DWI charge.She will be able to come live with me,her mother and father,we have an extra room for them.

Usually courts side with mothers, so I bet she'll get custody.

Courts generally side with the most appropriate parent, not just the mother, it is their job to do what is best for the children. With her boyfriends criminal record, and the fact he is on probation, the courts will like look at him as a risk to the children right now and award custody to your daughter, but she needs to be willing to bring it all up in court. She has custody until he establishes himself as the father. When he does that custody is decided then. If he has already done so while they were together, then she will have to file court documents to establish herself as the custodial parent. A guardian fo the child will be appointed and they will assist the courts in deciding. Just because she is female doesn't mean she receives custody. Though what you have stated gives her a great chance especially if she is the main caretaker. I strongly suggest she files for the establishment anyways if she leaves him...that way there is no doubt where he stands in regards to visitation. If she does it later and he cleans up his act it will be a lot harder then.
