If there is violence against a child and the parents aren't protecting that child, then CPS should be involved.. first they can give the protection to the child as well as help the abused parent get out of the abusive situation. Be careful though with CPS, if for any reason they feel they are being used for anything other than protection they will become your worse enemy of which you don't want. as far as the custody, that is a matter to be taken in front of a judge however with the assistance of the CPS the abused parent can go for temporary custody until it is heard. You need to consult an attorney before getting CPS involved.

If CPS is aware of a child being abused it is their oblagation to take that child out of the home, they will usally tell the parent that the child is residing with that they have to contact a family member to come take the child or they will take the child in custody. this happened to my daughter and she called me and i have had my granson from the age of 4 and he is now 18 and just gradurated. All cases are not like this the parent can get help and ask for the child back. But has to prove to the court there has been some treatment for the abuse.
