Split Custody

My son, 16 yrs old, is one of three children living with his mother in joint custody in New York. He has decided he would rather live with me now. We are not in the child protection services system because I have always paid support/alimony payments on time. It was recommended to me by my lawyer, at the time of the divorce, to stay out of the system and make decisions equitably between my ex-wife and myself as long as we could agree on the issues. My question regarding this agreement is; Can we make this custody change on our own by signing a notrized contract and avoid family court? Also, how would the child support be calculated in an instance such as this and can we also keep this out of family court accordingly?

If you two can come to some agreement on how to work this out on your own. then you should be able to keep it out of the courts.

the main reason for the courts is to mediate between people who can't come to an agreement.
