Temporary Custody

My husbands daughter has lived with us for a year and half now. Her mother has made 4 attempts to contact her and 3 attempts to have her visit with her. She calls about once ever 4 months and this has become an issue for the child. Can my husband get temporary custody until he can get an attonery and fight for full custody?

You don't need a lawyer to fight for full custody (yes, sometimes they are nice to have there, but they cost a lot ) What you need to do is go to your local family court and file a petetion for full custody (first, is there any court paperwork about custody/visitation in place now?, if there is you need to file a modification for it!) When you fill out the paperwork, you will have a bunch of info to fill out and part of it will ask why you are filing it, just state your reasons there and you will have to sign it in front of a notory. You will then receive paperwork in the mail (normally) that will have a court date scheduled on it. Keep notes from now on (if you haven't been already) write down everytime she calls and when the call ends, the dates she sees the child, just any proof of what you have. Be sure to attach a copy of it to your court papers you file and keep copies for yourself. When you go to court, state your case, just like you have in your letter above. Good luck to you!
