Temporary guardianship?

My son is will be 18 in January, with 2 years of school left. Custody is with his mom. He wants to live with me, his mom agrees. What documents can be signed to make it a legal action so that child support will stop going to her and giving me guardianship? We live in Indiana

Over the past year or two, my son has been into some trouble. His mom claims "she cannot control him" and everytime my wife and I make arrangements to move him with us, his mom "changes her mind" because she needs his support money. His mom is a habitual liar and cannot be trusted. I need to "lock her in on an agreement" so that he will stay with us until he is of age. Are there documents we can sign as long as we both agree, without involving lawyers? Afterall, he will be 18 in 6 mos!

You will neeed to file a motion with the court to modifly the orignal order of custodyand support. Support stops at the sge of 18 even if the child is still in school. The mother will be served and she can appear in court and tell the judge she agrees to this or you can get a notized letter from her stating she has placed the child in your care and want to gine you custody.

Although I think the age that support stops has changed to 21 in Indiana, I was curious if the notorized letter would be sufficient enough. This confirms that for me.
